Terms and Conditions
Please read this carefully because it sets out the terms of a legally binding agreement between you and Automotive Retail Ltd (trading as Auto Retail Network).
If you do not agree with the terms and conditions (or are not authorised to do so on behalf of your business or work) you should not purchase products and services from Auto Retail Network, and should cancel any orders made in accordance with your cancellation rights.
We recommend that you print and save a copy of these terms and conditions for your records.
These terms and conditions were last updated on 1st November 2017 and replace all previous terms and conditions. Auto Retail Network may update these terms and conditions for legal or regulatory reasons, or to reflect changes in our services or business practices.
You should regularly check to see if any changes have been made. If you are an Auto Retail Network publication subscriber any changes will become effective from the date of your next payment following the change unless we notify you otherwise.
We may in exceptional circumstances cease to operate Auto Retail Network or cease to provide our products and services. If we do so, then we will have no further obligation to you, unless you are a publication subscriber in which case we will offer you a refund of a proportion of the unexpired period of your subscription under the terms listed below.
2. Access and Use
We recommend that you also read our Copyright Policy that summarises how you can use Auto Retail Network material and member benefits.
From time to time we may invite specific groups of users to access certain benefits which may be the same as, or different to, the access given under other subscriptions.
You must provide Auto Retail Network with accurate, complete registration information and it is your responsibility to update and maintain changes to that information. Auto Retail Network is entitled to rely on any information you provide to us.
On registration, you will choose a username and password (ID). You are not allowed to share your ID or give access to Auto Retail Network through your ID to anyone else.
Auto Retail Network may cancel or suspend your access if you share your ID without further obligation to you. You may not create additional registration or subscription accounts for the benefit of others or with the aim of avoiding our use of IDs to control access to and use of membership of Auto Retail Network.
4. Publication Subscriptions
We offer subscription services through Auto Retail Network and reserve the right to vary the amount of content and types of service that we make available to different categories of user. This means that we may increase or reduce the content and services that are only available to paying subscribers from time to time.
We will try to process your subscription promptly but does not guarantee that your subscription will be activated by any specified time. By submitting your payment and other subscription details, you are making an offer to us to buy a subscription. Your offer will only be accepted by us and a contract formed when we have successfully verified your payment details and email address, at which point we will provide you with access to your subscription.
Auto Retail Network reserves the right to reject any offer in its discretion, for any or no reason.
When you subscribe you must provide us with complete and accurate payment information. If we do not receive payment authorisation or any authorisation subsequently cancelled, we may immediately terminate or suspend your access to your subscription and may in suspicious circumstances contact the issuing bank and/or law enforcement authorities/other appropriate third parties.
If you are entitled to a refund under these terms and conditions we will credit that refund. If you buy a subscription using a corporate credit card than we will treat your subscription as being for the benefit of both you and the relevant company.
The subscription price will be made clear to you on our subscription pages or otherwise during the subscription process and may vary from time to time or by country. You agree to pay the fees at the rates and frequency notified to you at the time you take out your subscription.
We will always tell you in advance of any increase in the price of your subscription and offer you an opportunity to cancel it if you do not wish to pay the new price.
If we incorrectly state a price to you whether online or otherwise, we are not obliged to provide you with a subscription at that price, even if we have mistakenly accepted your offer to buy a subscription at that price, and reserve the right to subsequently notify you of any pricing error.
If we do this, you may cancel the subscription without any obligation to us and we will refund you any money you have paid us in full or you may pay the correct price. If you refuse to exercise either of these choices then we may cancel your subscription and will refund you any money you have paid us in full. We will always act in good faith in determining whether a genuine pricing error has occurred.
Subscription Renewals: We will send you an email or contact you letting you know when your subscription is close to ending (unless you have already told us that you wish to cancel your subscription).
Unless you then notify us before the end of your subscription period that you no longer wish to receive it, your subscription will renew for a similar period. We will charge the subscription renewal fees to your credit card or invoice you, as in the previous subscription period. We will notify you in advance of any changes to the price in your subscription that will apply upon renewal.
Cancellations and refunds: New subscribers may cancel their subscription within 60 days of the commencement date of their subscription. This must be notified to us by email to email@example.com or by calling the subscription line on 01572 724687. If the subscription has been paid for a full refund will be made. Cancellations of subscriptions made after 60 days of their commencement date do not have any right to cancel until the end of the subscription period.
Existing subscribers may cancel their subscription renewal within 30 days of the renewal date or before we have started providing any part of it to you (in which case we will provide you with a full refund), then you agree that once we have started providing any part of your subscription to you, you do not have any right to cancel your subscription or any part of it until the end of your then current subscription period.
Although you may notify us of your intention to cancel at any time, such notice will only take effect at the end of your then current subscription period. You may notify us of your wish to cancel your subscription by contacting us on + 44 (0) 1572 724687 or e-mailing firstname.lastname@example.org
Auto Retail Network reserves the right to suspend or terminate your subscription if you breach these terms and conditions, with or without notice and without further obligation to you. You will not be entitled to any refund in these circumstances.
If, however we terminate or suspend your subscription for any other reason and/or permanently cease operating Auto Retail Network or cease to provide subscription services then, unless there are exceptional circumstances, we will provide you with a pro rata refund based on the actual cost of providing the product or service you have subscribed to and any remaining and unexpired period of your subscription.
This means Auto Retail Network will take a charge against your subscription for administration, overheads, office and other reasonable costs. You will not receive a full pro-rata refund.
Trial Subscriptions: We may from time to time and at our discretion make a free trial available to subscribers and non-subscribers, in which case we will only charge you for your subscription with effect from the expiry of the free trial period. No more than one free trial per subscriber is allowed in any twelve-month period.
5. Conference and event bookings
Booking Terms & Conditions
Once we have received your booking we will send you a confirmation of your place(s). Any errors or changes in your confirmation must be notified to us in writing immediately.
Once you have booked your place(s), should you be unable to attend a substitute delegate(s) from your company may attend at no extra charge. You must put any changes of delegate names in writing to us prior to attending the event.
You can cancel your place(s) in writing up to 30 working days prior to the date of the event and you will then receive a full refund. After this date, no refunds can be made or invoices cancelled and the full fee will be payable.
All places must be fully paid for in advance of attending the event. If they are not we will refuse admission. No refunds will be given in respect of non-attendance at the event.
Disclaimer: While all programmes are correcting at time of publication, Auto Retail Network (ARN) reserves the right to change details of the event and the agenda without notice. Alterations may occasionally be necessary due to circumstances beyond our control.
Where circumstances force the ARN and/or its subsidiaries to cancel a conference, the liability of the ARN and/or its subsidiaries shall be limited to a refund of any fees paid for this event. ARN and/or its subsidiaries is not liable for any consequential loss.
Views expressed by speakers are their own. ARN disclaims any liability for advice given, or views expressed, by any speaker at the event or in any documentation provided to delegates.
Professional photography and video production may be taking place at the event and these images may be used for publication. Please note that by attending the event you are giving your consent for your image to be used on any materials.
6. Report purchases
Once we receive your (the customer) written order we will dispatch the report directly to you (or your named recipient) by Royal Mail post service, or in the case of electronic versions by email. Unless otherwise notified to you this will be within 48 hours of receipt of the order. If we are not notified in writing to email@example.com within 7 working days following the date of the order that the Report has failed to arrive we will deem the report has been safely received.
If you have any queries regarding the Reports content or accuracy and/or it does not meet the description as published on the Auto Retail Network website www.auto-retail.com you must notify us in writing to firstname.lastname@example.org of your concerns within 14 working days of the reports order. If you fail to do this we will deem the report meets your requirements.
The Report is issued under licence and is subject to copyright. It is supplied solely for the customer’s own use within a single company title. The Report or any part of it cannot be disclosed, sold or sub licensed to third parties including distributors, agents, subsidiaries, holding companies or customers, at any time including the future, without specific written consent from Auto Retail Network.
The customer accepts full responsibility for their actions and any consequences of those actions, however caused, while in possession of the report.
Before disposal of any computer systems containing the Report, it is the customer’s responsibility to ensure the data cannot be recovered from the system.
If the customer is a marketing, mailing or similar type of person or company, they are NOT permitted to use the Report other than for a specific named client or clients. The client name will be stated on this document in this instance.
Auto Retail Network will have no liability to any person for any loss or damage arising out of use of the Report or information contained within. While every effort is made to ensure the quality of the Report, Auto Retail Network and its partners will not be held responsible for any errors or omissions.
You may not license or transfer any of your rights under these terms and conditions. We may transfer any of our rights or obligations under these terms and conditions but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.
If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.
Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.
